Terms of Service

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and Aesthetic Studio Creator S.R.L. ("GlowMD", "we", "us"). They govern your access to and use of the GlowMD website, mobile applications, and related services (the "Service"). By creating an account, uploading photos, completing the skin quiz, or otherwise using the Service, you accept these Terms.

If you do not accept these Terms, you must not use the Service.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract in your jurisdiction. By using the Service, you represent that you meet this requirement. We reserve the right to request proof of age and to terminate accounts of users who do not meet it.

3. Your Account

  • You are responsible for providing accurate and up-to-date information.
  • You are responsible for keeping your password confidential and for all activity under your account.
  • You may not share your credentials or let another person use your account.
  • Notify us promptly at legal@glowmd.com if you suspect unauthorized access.

4. The Service

GlowMD provides a personalized skincare experience, including:

  • A self-guided skin quiz;
  • Optional photo-based skin analysis (see Biometric Data Consent);
  • Personalized AM/PM routines with product suggestions;
  • Anti-aging protocols and aesthetic procedure guides;
  • A progress dashboard, streak tracker, and visual comparison tools.

All content is informational (see Medical Disclaimer). The Service is not a substitute for professional medical advice.

We may add, modify, or discontinue features at any time. We will give reasonable notice of material changes to paid features.

5. Subscriptions and Billing

5.1 Plans

  • Free: Basic skin quiz and preliminary analysis.
  • GlowMD Premium: Full personalized routine, procedure guide, progress tracker, and anti-aging protocol. €9.99 per month or €79 per year (billed annually, equivalent to €6.58 per month).

Prices are inclusive of VAT where applicable. Currency and availability may vary by region.

5.2 Billing

Payments are processed by Stripe. By subscribing, you authorize GlowMD (via Stripe) to charge your payment method for the selected plan and any applicable taxes, on the billing cycle you choose (monthly or annual), on a recurring basis until you cancel.

5.3 Trial

New subscribers may be offered a 7-day free trial. You can cancel any time during the trial; no charge is made. Abuse of trials (repeat sign-ups with different emails) may result in denial of future trials.

5.4 Cancellation

You can cancel your subscription at any time from your profile or by emailing legal@glowmd.com. Cancellation takes effect at the end of the current billing period; you retain access until then.

5.5 Refunds and EU withdrawal right

Consumers in the European Union have the right to withdraw from a contract within 14 days of starting the subscription without giving any reason, under Directive 2011/83/EU. To exercise this right, email legal@glowmd.com with your account email and the word "withdrawal" in the subject. If you have started using the digital service during the withdrawal period, you expressly agreed to the immediate performance and acknowledge that the right of withdrawal is lost at that moment only for the part already consumed; any remaining pro-rated value will be refunded.

Outside the 14-day window, payments are non-refundable, except where mandatory law requires otherwise or we decide, in our sole discretion, to make an exception.

5.6 Price changes

We may change subscription prices with at least 30 days' notice via email. Price changes apply to the next renewal; you can cancel before renewal to avoid the new price.

6. Acceptable Use

You must not:

  • Use the Service for any unlawful purpose or in violation of applicable law;
  • Upload photographs of any person other than yourself, or without their verifiable consent;
  • Reverse-engineer, decompile, scrape, or probe the Service or its infrastructure;
  • Use bots, automation, or crawlers against the Service;
  • Share, resell, or sublicense your account or access;
  • Attempt to bypass paywalls, usage limits, or security controls;
  • Upload malware, offensive material, or content that infringes rights of others;
  • Use the Service to provide medical advice to third parties;
  • Interfere with other users' enjoyment of the Service.

We may suspend or terminate accounts that violate these rules.

7. User Content

You retain ownership of the photographs, quiz answers, and other content you submit ("User Content"). By submitting User Content, you grant us a limited, worldwide, royalty-free license to host, store, process, and display it solely to provide the Service to you.

We do not use your User Content to train AI models, and we do not sell it or share it for marketing purposes. See the Privacy Policy and Biometric Data Consent for details.

You are responsible for your User Content and represent that you have the rights to submit it.

8. Our Intellectual Property

The Service, including its code, design, trademarks, and textual content (excluding User Content), is owned by Aesthetic Studio Creator S.R.L. or its licensors and is protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable license to use the Service solely in accordance with these Terms. All rights not expressly granted are reserved.

9. Affiliate Links

The Service may contain affiliate links to products sold by third-party retailers. If you purchase a product through such a link, we may receive a commission at no additional cost to you. Affiliate relationships do not influence which products we recommend; recommendations are based solely on skincare fit.

10. Third-Party Services

The Service relies on or links to third-party services (including Supabase, Stripe, Vercel, Resend, Google). We are not responsible for the availability, content, or practices of third parties. Your use of third-party services is subject to their terms.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. Nothing in this section limits your statutory rights as a consumer under applicable law.

12. Limitation of Liability

To the maximum extent permitted by law, Aesthetic Studio Creator S.R.L. will not be liable for:

  • Indirect, incidental, consequential, special, exemplary, or punitive damages;
  • Loss of profits, revenue, data, goodwill, or business opportunity;
  • Adverse skin reactions, medical outcomes, or decisions based on information from the Service (see Medical Disclaimer).

Our total aggregate liability for any claim arising from or related to the Service is limited to the greater of (a) €100 or (b) the total amount you paid to GlowMD in the twelve (12) months preceding the event giving rise to the claim.

These limits do not apply where prohibited by law, including in cases of gross negligence or willful misconduct.

13. Indemnification

You agree to indemnify and hold harmless Aesthetic Studio Creator S.R.L., its officers, employees, and contributors from any claim, liability, damage, or expense (including reasonable legal fees) arising out of:

  • Your breach of these Terms;
  • Your User Content;
  • Your violation of any third-party right, including privacy or intellectual property rights.

14. Termination

You may stop using the Service and delete your account at any time from your profile, or by emailing legal@glowmd.com. We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, Sections 7, 8, 11, 12, 13, 16, and 17 survive.

15. Modifications to Terms

We may modify these Terms. We will provide at least 30 days' notice of material changes via email or in-app notification before they take effect. Your continued use after the effective date constitutes acceptance of the updated Terms. If you do not accept the changes, you must stop using the Service before they take effect.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania, without regard to conflict-of-laws rules. For users acting as consumers within the EU, mandatory consumer protection laws of your country of residence also apply.

Any dispute that is not resolved through the process in Section 17 shall be submitted to the competent courts of București, România, without prejudice to your right, as a consumer, to bring proceedings before the courts of your country of residence.

17. Dispute Resolution

Before filing any formal claim, we agree to try to resolve the dispute informally:

  1. Negotiation — email legal@glowmd.com with a description of the issue; we commit to a substantive response within 15 business days.
  2. Mediation — if negotiation fails within 30 days, either party may propose mediation via a mutually agreed mediator.
  3. Arbitration or court — if mediation fails within 60 days, either party may initiate formal proceedings before the competent courts, or arbitration where both parties agree in writing.

EU ODR platform: If you are a consumer in the EU, you can use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Our contact email for this platform is legal@glowmd.com.

18. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, Medical Disclaimer, and Biometric Data Consent, constitute the entire agreement between you and us regarding the Service.
  • Severability. If any provision is held unenforceable, the remainder remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver.
  • Assignment. You may not assign these Terms; we may assign them in connection with a reorganization, merger, or sale of assets.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
  • Notices. We may notify you by email to the address associated with your account or by an in-app message.
